Buchwald Scores a “Perfect” Environmental Record for a 4th Time

Assemblyman Buchwald Receives 4th Consecutive Perfect Score for His Strong Environmental Record

For the fourth year in a row, Assemblyman David Buchwald (D-Mount Kisco) has received a perfect legislative score from the Environmental Advocates of New York, a leading environmental watchdog group in the state. Assemblyman Buchwald has had an unbroken perfect score for the entirety of his time in the New York State Assembly.

“Being recognized for four straight years as having a perfect environmental voting record means a lot to me,” said Assemblyman Buchwald. “Westchester residents sent me to the State Assembly to deliver the message that we have to protect clean air and water, keep toxic chemicals away from our children and emergency responders, and take on the challenges of climate change. I fight for those principles and at the same time seek to grow our economy through environmental innovation and energy efficiency.”

Every year, Environmental Advocates grades New York State lawmakers according to their votes on bills that could help or harm our air, land, water, wildlife and health. Based in Albany, the group monitors state government, evaluates proposed laws and champions policies and practices that ensure the responsible stewardship of our shared environment.

Earlier this year, Assemblyman Buchwald co-sponsored environmentally responsible legislation that classifies hydrofracking waste as hazardous material and keeps harmful chemicals out of children’s products.

Assemblyman Buchwald Helps Secure Significant School Aid Increase for Local School Districts

After years of suburban school districts in New York State falling victim to state budget cuts, Assemblyman David Buchwald (D-White Plains) announced that public schools in his State Assembly District will see a substantial increase in state aid for the 2016-17 school year. The increase in state aid was led by the end of the Gap Elimination Adjustment (also known as the GEA). Of the nearly $1.5 billion in overall additional state education aid in the budget, $434 million has been appropriated for the end of the GEA. In addition to ending the GEA, $627 million has been included in the state budget to boost Foundation Aid, a broad-based level of aid for school districts. In total, there is an additional $8.9 million in new state aid earmarked for public schools based in Buchwald’s Assembly District, which encompasses all or part of nine school districts in central and northern Westchester.

“Since I entered the State Assembly three years ago, I have made it my mission to make sure that our local schools are appropriately funded and that our children can get the education they deserve,” said Assemblyman Buchwald. “With the full restoration of the GEA, school districts can more confidently plan their yearly budgets, thereby ending an era of uncertainty for the education community and taxpayers. I have received thousands of letters solely on this issue, and I am happy to report back to my constituents that we have repealed the GEA. Although we have scored this major victory for students, parents, educators and taxpayers across the state, I will always be fighting on behalf of our local schools.”

A breakdown of school aid increases within Buchwald’s Assembly District are as follows:

· Bedford Central School District – $754,077, a 13.2 % increase in aid.
· Byram Hills School District – $ 272,189, a 8.3% increase in aid.
· Chappaqua School District -$954,262, a 15.0% increase in aid.
· Harrison School District – $498,032, a 13.3% increase in aid.
· Katonah-Lewisboro School District – $1,112,813, a 17.7% increase in aid.
· North Salem School District – $206,997, a 10.2% increase in aid.
· Ossining School District – $1,150,904, a 7.0% increase in aid.
· Valhalla School District – $140,486, a 3.1 % increase in aid (a $379,000 increase from ending of GEA, less changes in expense-based school aids).
· White Plains School District – $231,119, a 1.1% increase in aid (a $401,000 increase from ending of GEA, plus a $104,000 increase in Foundation Aid, less changes in expense-based school aids).

The above amounts and percentages do not include building aid, which is focused on capital expenditures and fluctuates from year to year. For some districts, additional building aid significantly increases the total aid amounts – for example in Ossining, where total aid including building aid went up $2.9 million, or 16.7%. Jumps in building aid also bring up the Valhalla and White Plains total aid figures.

Assemblyman Buchwald co-sponsored two pieces of legislation in the State Assembly that would have repealed the GEA: Assembly bills A.2271-C and A.5365. Buchwald has also attended various school board meetings and education forums across his Assembly District where he spoke on developments within the legislature on school funding issues.

David Buchwald’s Newly Passed Bill to Help Keep Drunk Drivers Off the Road

New Law Follows One Month After State Comptroller Finds Significant Non-Compliance with Leandra’s Law

As New Yorkers look forward to celebrating the upcoming holiday season in a safe and responsible fashion, Governor Andrew Cuomo has signed into law legislation to reduce drunk driving among repeat violators of state law. The bill’s sponsor, Assemblyman David Buchwald (D-Westchester) introduced the legislation (bill number A.6222) earlier this year to close a loophole that allows repeat DWI offenders under probation to potentially operate a motor vehicle while intoxicated, despite the generally mandated use of an ignition interlock device (IID) under what is known as Leandra’s Law.

An IID is an apparatus that is similar to a breathalyzer and is often attached to the ignition system of a motor vehicle as a condition of probation stemming from traffic-related infractions. The vehicle can only be started if the driver blows into the ignition interlock and his or her blood alcohol content (BAC) is below the legal limit of .08 BAC. Assemblyman Buchwald’s legislation, sponsored by Senator Michael Nozzolio (R-Seneca Falls) in the State Senate, strengthens part of Leandra’s Law, which was signed in 2009 and named after 11-year-old Leandra Rosado, who was killed in a motor vehicle operated by a drunk driver.

Last month, State Comptroller Thomas DiNapoli published an audit of drunk drivers who were ordered to install IIDs in New York City between 2012 and 2014. The audit found that of over 53,000 IIDs ordered by the courts, only 13,810 drivers, or just 25 percent, were compliant.1 For those who violated their probation or conditional discharge, the requirement to use an IID could not be extended to make up for the missed time on probation during which the violation occurred. The new law grants the courts the ability to extend the sentence of mandated use of an ignition interlock device if a DWI offender violates his or her probation or conditional discharge. Buchwald’s bill, which was recommended by New York’s Office of Court Administration, provides judges the ability to extend the period in which the use of an IID is mandated in the vehicle of a DWI offender who violates his or her probation.

“Over the years we’ve seen senseless accidents and tragedies as a result of drunk driving in every corner of the state,” New York State Comptroller Thomas P. DiNapoli said. “Ignition interlocks, coupled with aggressive monitoring of DWI offenders, are an effective way to prevent intoxicated drivers from getting behind the wheel and endangering the welfare of pedestrians and motorists. I commend Assemblyman Buchwald, as well as Senator Nozzolio, for their efforts to strengthen Leandra’s Law and thank Gov. Cuomo for signing this much needed measure into law.”

“Leandra Rosado’s story reminds us that life is precious, and in her memory New York State has taken steps to reduce the tragic loss of life due to drunk driving,” said Assemblyman Buchwald. “Ignition interlock devices save lives, and by granting our courts the ability to extend the period of mandated time these devices are required for repeat offenders, we will increase the chance of preventing further tragedies like Leandra’s from happening in the future. I am thankful that Governor Cuomo signed into law this initiative to reduce drunken driving and keep repeat offenders off the roadways. I wish all New Yorkers a happy and safe holiday season.”

“Mothers Against Drunk Driving thanks Assemblyman David Buchwald for working to pass A.6222, and Governor Andrew Cuomo for signing this bill into law, that will increase the use of interlocks by individuals that have been found guilty of driving drunk in New York State,” states Rich Mallow, State Executive Director, Mothers Against Drunk Driving.

According to the Centers for Disease Control, 20 percent of all children who are killed in traffic-related accidents perish as the direct result of a drunk driver.2 In addition, over 22,000 DWI offenders in New York State are repeat violators, according to the National Highway Traffic Safety Administration.3 The new law helps prevent this unnecessary loss of life by requiring that probationary terms remain in effect after a declaration of delinquency, and allowing the court the ability to extend the end date of the oversight and utilization of the IID.

Assemblyman Buchwald’s legislation passed unanimously in both the State Assembly and the State Senate.
